Injury award upheld
As seen in The Denver Post
The Colorado Court of Appeals has upheld a $435,000 award to a woman who was injured when a box fell on her while she was shopping at a Wal-Mart store with her husband.
The court disagreed with an appeal by Wal-Mart Stores Inc., whose attorneys argued the award was excessive.
Barbara Trujillo was injured when a 30-pound box fell off a four-shelf cart at a Wal-Mart store and landed on her back and neck.
According to court documents, a store employee had violated several company safety policies by overloading the cart and pushing it without being able to see over it.
